Welcome to Gigsouk. These Terms & Conditions ("Terms") govern your access to and use of the Gigsouk website, applications, and services (the "Platform"). By registering, browsing, or transacting on the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

"Gigsouk" / "Platform" — the website at gigsouk.com and associated mobile applications operated by Gigsouk.

"User" — any individual or entity that accesses or uses the Platform, including Buyers and Sellers.

"Buyer" — a User who purchases digital products, services, or tips through the Platform.

"Seller" — a User who lists and sells digital products or freelance services on the Platform.

"Content" — any text, images, files, templates, code, designs, reviews, or other materials uploaded to the Platform.

"Order" — a confirmed transaction between a Buyer and a Seller.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. By creating an account, you represent that:

You have the legal capacity to enter into binding agreements.

All information you provide is accurate and current.

You will maintain the security of your account credentials.

3. Account Registration

You may register using email or social login (Google).

Each individual or business may maintain only one account.

You are responsible for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Marketplace Services

Gigsouk provides a platform connecting Buyers and Sellers. We are not a party to the transactions between Users, nor do we guarantee the quality, safety, or legality of listed Content.

a) Digital Templates & Products

Sellers may list digital templates, design assets, code snippets, and other downloadable products. All products must comply with our Content Guidelines.

b) Freelance Services

Sellers may offer custom freelance services. Orders are governed by the scope, timeline, and deliverables agreed upon between Buyer and Seller.

c) Creator Tips

Buyers may send voluntary tips to creators. Tips are non-refundable.

5. Payments & Fees

All payments are processed through our payment partner, Razorpay, in INR (₹) or other supported currencies.

Gigsouk charges a platform commission on each sale, as specified in the Seller Agreement.

Sellers receive payouts according to the payout schedule outlined in their Seller Dashboard.

Buyers are charged at the time of purchase, including applicable taxes.

We reserve the right to modify pricing and commission structures with 30 days' notice.

6. Intellectual Property

a) Your Content

You retain ownership of Content you upload. By listing Content on the Platform, you grant Gigsouk a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your Content in connection with the Platform.

b) Buyer License

Upon successful purchase, Buyers receive a license to use the purchased Content as specified in the product listing. Unless explicitly stated, purchases do not transfer copyright.

c) Platform IP

The Gigsouk name, logo, UI design, and proprietary code are owned by Gigsouk and may not be copied, modified, or distributed without prior written consent.

7. Prohibited Conduct

You agree not to:

Upload Content that infringes intellectual property rights of third parties.

List counterfeit, plagiarized, or misrepresented products.

Engage in fraud, manipulation, or abuse of the ratings/review system.

Attempt unauthorized access to the Platform, other accounts, or our systems.

Use the Platform for illegal activities, harassment, or hate speech.

Circumvent Platform fees by conducting transactions outside Gigsouk.

Scrape, crawl, or automated-access the Platform without permission.

8. Content Moderation

Gigsouk reserves the right to review, edit, or remove any Content that violates these Terms or our Content Guidelines. We may use automated tools and manual review to detect violations. Repeated violations may result in account suspension or permanent ban.

9. Dispute Resolution

We encourage Buyers and Sellers to resolve disputes amicably through our messaging system.

If a resolution cannot be reached, either party may escalate the dispute to Gigsouk's Support team.

Gigsouk will review the dispute and may issue refunds, require revisions, or take other actions at its discretion.

Gigsouk's decision in dispute resolution is final and binding.

10. Limitation of Liability

To the fullest extent permitted by law:

Gigsouk provides the Platform "as is" without warranties of any kind, express or implied.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim shall not exceed the fees paid by you to Gigsouk in the 12 months preceding the claim.

We are not responsible for the actions, Content, or conduct of any User.

11. Indemnification

You agree to indemnify and hold harmless Gigsouk, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

You may close your account at any time through your account settings.

We may suspend or terminate your account with or without notice for violations of these Terms.

Upon termination, your right to use the Platform ceases immediately. Provisions that by nature survive termination (e.g., IP rights, liability limitations, indemnification) will remain in effect.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
